Regulatory Process

On June 29, 2007, Golden Triangle Storage applied for a Certificate of Public Convenience and Necessity for the project from the Federal Energy Regulatory Commission (FERC). A copy of the application and other information are available on the FERC’s Web site, www.ferc.gov in the eLibrary section; perform a general search for Docket No. CP07-414. Hard copies of the FERC application also are available at the public libraries in Beaumont (main library), Port Arthur, Orange, Vidor and Nederland.

FERC will serve as the lead regulatory agency overseeing the participation of a number of other federal, state and local agencies in reviewing and permitting the facility. AGL Resources will work closely with these agencies as well as community leaders, landowners and other interested parties throughout the process.

FERC hosted a public site visit and scoping meeting in Beaumont on Aug. 28, 2007, to provide the opportunity for landowners and other interested parties to make comments on the record regarding the Environmental Assessment of the project. Approximately 10 people attended the scoping meeting and a number of community leaders made comments supporting the project for its economic benefits to the region.

On Dec. 7, 2007, FERC issued an Environmental Assessment on the project. Then, on Dec. 31, 2007, the FERC Commission voted to issue a Certificate of Public Convenience and Necessity for Golden Triangle Storage. (Both documents may be accessed through the FERC Web site (www.ferc.gov, in the eLibrary section; search for docket number CP07-414.) Golden Triangle Storage has 30 days to accept the certificate. The company must also comply with all outstanding requirements, file a construction plan for approval and secure all required permits from other agencies. It expects to complete these steps and begin construction in the first quarter of 2008.
